Prosecution Termination over Death Found Unconstitutional

The Russian Constitutional Court has found unconstitutional the Criminal Procedure Code provisions that allow the termination of a criminal case upon the death of a suspect without the consent of his or her close relatives who insist that the suspect was innocent. This ruling means that the decision to terminate the high-profile criminal case related to an incident on Leninsky Avenue in Moscow involving the car of a LUKOIL top manager should be revised since the relatives of the dead suspect insist on her innocence. The court based its ruling on the right to a legal defence and the presumption of innocence.
