Russia’s Economic Court Publishes First Dissenting Opinion

For the first time in its history, Russia’s Supreme Arbitrazh (Economic) Court published a dissenting opinion of one of the judges. Previously, the practice of publishing dissenting opinions existed in Russia only in the Constitutional Court. The issue in this case was whether interest is payable where the principal amount has been paid under a settlement agreement. The majority held that the settlement means that the dispute is completely resolved and no further interest may be claimed. Judge Sergey Sarbash dissented arguing the interest is payable up to the date of the certification of the settlement by a court.
